FRUITSTAND® is a brand operated by Fruitstand LLC (“FRUITSTAND,” “we,” “us,” or “our”).
This Privacy Policy describes how Fruitstand LLC collects, uses, discloses, and otherwise processes personal information when you visit or use our website, purchase our products, sign up for marketing communications, communicate with us, attend or interact with our events or promotions, or otherwise use our services (collectively, the “Services”).
Our online store is powered by Shopify. We also use third-party service providers, including Mailchimp, to provide certain marketing and communications services.
If there is a conflict between this Privacy Policy and our Terms of Service concerning the collection, use, processing, or disclosure of personal information, this Privacy Policy controls.
PERSONAL INFORMATION WE COLLECT OR PROCESS

EMAIL MARKETING
If you subscribe to FRUITSTAND email marketing, we may use your email address and related information to send you communications about products, launches, restocks, promotions, events, offers, and other FRUITSTAND news.
You may unsubscribe from promotional email at any time using the unsubscribe link included in our marketing emails.
Unsubscribing from marketing email does not prevent us from sending non-promotional communications that are necessary to provide the Services, such as order confirmations, shipping updates, account notices, or customer service messages.
Email marketing consent and SMS marketing consent are managed separately. Unsubscribing from email does not automatically unsubscribe you from SMS marketing, and opting out of SMS does not automatically unsubscribe you from email marketing.
SMS MARKETING
If you provide your mobile phone number and affirmatively opt in to receive SMS marketing from FRUITSTAND, we may use your phone number to send recurring marketing text messages regarding product launches, drops, restocks, promotions, events, offers, and other FRUITSTAND news.
Providing us with a phone number by itself does not constitute SMS marketing consent where affirmative consent is required by applicable law.
We may collect and retain information associated with your SMS subscription, including your phone number, consent status, the date and method by which consent was provided, and opt-out or unsubscribe records. We use this information to administer our SMS program, maintain consent records, honor opt-out requests, and demonstrate compliance with applicable requirements.
We may use service providers, including Shopify and Mailchimp, to collect or maintain SMS subscription information and facilitate or deliver SMS communications.
You may opt out of FRUITSTAND marketing texts at any time by replying STOP to a marketing message. You may receive a final confirmation message after opting out.

Consent to receive marketing texts is not a condition of purchasing from FRUITSTAND.

RELATIONSHIP WITH SHOPIFY
Our Services are hosted by Shopify.
Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve Shopify’s services and the functionality it provides to FRUITSTAND.
Information you submit through our store may be transmitted to and processed by Shopify and other service providers, including in countries other than the country where you live.
We may also use Shopify features that use information about interactions with our store, Shopify, and other merchants to provide enhanced services, analytics, fraud prevention, personalization, or advertising functionality.
In some circumstances, Shopify may process personal information for its own purposes and be independently responsible for that processing.

RELATIONSHIP WITH MAILCHIMP
We use Mailchimp, an Intuit service, to provide email and SMS marketing, audience management, and related communications services.
When you subscribe to or interact with FRUITSTAND marketing, we may provide Mailchimp with personal information necessary to operate those services. Depending on how you interact with us, this may include your email address, phone number, subscription status, consent information, customer information, and engagement with communications.
Mailchimp generally processes this information in connection with providing its services to us, although Mailchimp or Intuit may process certain information for their own purposes as described in their applicable privacy notices.
